The CVS Health® MyChart® ("MyChart") is licensed from Epic Systems Corporation and provided by CVS Health Corporation and its subsidiaries, including MinuteClinic® LLC, its subsidiaries and managed entities, and Coram® CVS Specialty® Infusion Services (referred to as "CVS Health" "us" or "we") to CVS Health patients (referred to as "you," "patients" or "users").

These terms of use are a legal Agreement entered between CVS Health and you. By registering, accessing or using MyChart, you agree to be bound by these terms and conditions of use and our Privacy Policy. If you do not agree to be bound by these terms, you are not permitted to access or use this service. These terms may be updated changed at any time in the discretion of CVS Health and updated terms will be posted in MyChart for user access.

MyChart is an online health management tool that provides patients with secured web-based access to portions of their electronic medical record and allows secure messaging with our providers or clinics

Your Electronic Health Record

Information about the care and services you receive at a CVS Health affiliated provider, such as medical history, current conditions, treatment plan and treatments given is maintained in the electronic health records at CVS Health.

A patient's entire health record is not reproduced online in MyChart. CVS Health may decide which types of information to release into MyChart, but may include appointments, prescriptions, basic test results, summary medical history and similar information. CVS Health reserves the right to terminate access to MyChart at any time, for any reason.

Availability and Eligibility

MyChart is only available to adults who are eighteen (18) years of age or older, or nineteen (19) years of age or older in Nebraska. CVS Health does not permit individuals who are under the age of eighteen (nineteen in Nebraska) to access or create a MyChart account.

No Warranties

Please note the medical or health care information provided on MyChart is not a replacement for proper medical attention. The content in your MyChart is for informational purposes only. It does not replace the advice or counsel of a doctor, pharmacist or health care professional. CVS makes every effort to provide information that is accurate and timely, but makes no guarantee in this regard. You should consult with, and rely only on the advice of, your physician, pharmacist or health care professional. IN THE EVENT OF AN EMERGENCY OR URGENT MEDICAL SITUATION YOU SHOULD CALL 911.

Information on MyChart is provided "as is" without warranty of any kind and is meant for use only to support the patient's relationship with their current or future medical professional. User reliance on the material in MyChart is at your own risk.

Contact CVS Health directly for official copies of your medical record or to correct any discrepancies with the medical information listed in your record.

User Password Responsibilities

It is extremely important that you keep your MyChart access code, username and password completely confidential from everyone. If you make your log in information available to others, they will be able to view your medical information and communicate with CVS Health as if they were you. It is your responsibility to prevent disclosure of your access code and to change your password if you feel your security has been compromised. You can change your password online at any time.

Appropriate Use

Access to the MyChart system is granted to users for the purpose of furthering their medical care. Use of the system unrelated to this purpose may result in the suspension or termination of access privileges. Improper activities include, but are not limited to, the use of inappropriate or abusive language, reserving appointment times that are not needed or are frequently cancelled, and other activities that are deemed to cause a disruption to CVS Health’s operations in the sole discretion of CVS Health.

Security

YOU HEREBY ASSUME SOLE RISK OF ANY UNATHORIZED DISCLOSRES OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION, OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THIS SERVCE. 

MyChart is configured to be secure from unauthorized access, but CVS Health cannot be held responsible for:

  • Absolute security of all electronic communication transmissions between patient and CVS Health;
  • Unauthorized disclosure resulting from a user not logging out of an active session;
  • Unauthorized disclosure resulting from a lost or stolen user ID and password;
  • Unauthorized disclosure resulting from information printed by the user from MyChart;
  • Unauthorized disclosure resulting from personal computer settings or installed software products that may compromise information security; and/or
  • Similar events outside the control of CVS Health.


Use of Third Party Services

You may choose to use other services provided by third parties in conjunction with your use of MyChart. Such services may include, but are not limited to, translation services, location services, and other third-party offerings. Any links to such services are provided for your convenience only. Neither Epic nor CVS Health have control over the contents of these services, and neither Epic nor CVS Health accept any responsibility for them or for any loss or damage that may arise from your use of them. Such services may require you to submit your information to a third party, which may result in a copy of your information being used and/or stored by a third party. If you decide to access any such services in conjunction with your use of MyChart, you do so entirely at your own risk and subject to the terms and conditions of use for such services. Limitation of Liability and Indemnification

CVS HEALTH SHALL NOT BE LIABLE FOR ANY DAMAGES SUFFERED BY THE USER OR OTHER THIRD PARTIES RELATED TO, DIRECTLY OR INDIRECTLY, THE MATERIAL AND INFORMATION CONTAINED IN MYCHART. IN NO CIRCUMSTANCES WILL CVS HEALTHBE LIABLE TO THE USER OR ANY OTHER PERSON FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY TYPE, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. CVS HEALTHCANNOT GUARANTEE ACCESS TO THE MYCHART SYSTEM AND IS NOT LIABLE FOR THE USER'S INABILITY TO ACCESS OR VIEW THE INFORMATION CONTAINED ON THE SITE. By downloading or viewing the information on MyChart, the user agrees to hold CVS Health harmless and indemnify CVS Health against any damages, claims, or other claims asserted against CVS Health arising out of, or in any way connected with, the user's utilization of MyChart or the information contained therein.

Dispute Resolution

This Agreement shall be governed solely by, and construed solely in accordance with, the laws of the United States (including federal arbitration law) and the State of New York, excluding any rules of private international law or the conflict of laws which would lead to the application of any other laws. This Agreement will not be governed by the U.N. Convention on Contracts for the International Sale of Goods.

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING OUT OF OR RELATED TO THIS AGREEMENT OR ANY ASPECT OF THE RELATIONSHIP BETWEEN YOU, ON THE ONE HAND, AND CVS HEALTH OR ITS SUPPLIERS OR VENDORS, ON THE OTHER HAND, WHETHER BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY, WILL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION BEFORE A NEUTRAL ARBITRATOR INSTEAD OF IN A COURT BY A JUDGE OR JURY AND YOU AGREE THAT MINUTECLINIC AND YOU ARE EACH WAIVING THE RIGHT TO TRIAL BY A JURY. YOU AGREE THAT ANY ARBITRATION UNDER THIS AGREEMENT WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED AND YOU ARE AGREEING TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ACTION. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (currently available at https://protect-us.mimecast.com/s/kCfoCn5jz4ikp529SN-qIR?domain=adr.org), as amended by this Agreement. The arbitrator will conduct hearings, if any, by teleconference or videoconference, rather than by personal appearances, unless the arbitrator determines upon request by you or by us that an in-person hearing is appropriate. Any in-person appearances will be held at a location which is reasonably convenient to both parties with due consideration of their ability to travel and other pertinent circumstances. If the parties are unable to agree on a location, such determination should be made by the AAA or by the arbitrator. If you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, CVS Health will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. The arbitrator's decision will follow the terms of this Agreement and will be final and binding. The arbitrator will have authority to award temporary, interim, or permanent injunctive relief, or relief providing for specific performance of this Agreement, but only to the extent necessary to provide relief warranted by the individual claim before the arbitrator. The award rendered by the arbitrator may be confirmed and enforced in any court having jurisdiction thereof. Notwithstanding any of the foregoing, nothing in this Agreement will preclude you from bringing issues to the attention of federal, state, or local agencies and, if the law allows, they can seek relief against us for you.

With the exception of any of the language above in this Dispute Resolution provision relating to the waiver of class and representative actions, if Roxa court decides that any part of this Dispute Resolution provision is invalid or unenforceable, the other parts of this Dispute Resolution provision shall still apply. If a court decides that any aspect of the language above in this Dispute Resolution provision relating to the waiver of class and representative actions is invalid or unenforceable, then the entirety of this Dispute Resolution provision shall be null and void. The remainder of the Agreement will continue to apply and be unaffected by this severability provision.
